Looks like it was all just a prank, no one can verify the occurrence.  Pretty lame if it was.

Darn, after re-reading my last, I shouldn’t have done that in one sitting – it’s a bit wordy and somewhat confusing. I’ll try to be better on this one.

Oh, and I need to restate: I am not an attorney, therefore what I give is not legal advice. You want legal advice, seek out an attorney. I give what I understand to be correct based upon my training as a LEO and as a Use of Force Instructor – not legal advice.

Quote
…in TX you can use deadly force in a situation called criminal mischief after dark and can not be prosecuted criminally…

Many states have lawful provisions that, on their face, appear to grant the authority to use deadly force for given crime “X”. In my home state (Oregon) deadly force is authorized to interrupt certain felonies involving the use or threatened use of force; such as robbery, or burglary of a dwelling.

Regardless of what state law grants, we still can’t ignore federal law or case law. (Note: My reference materials are at my regular office, so you’ll have to trust me for now on what I’m about to post – I can’t give you the reference case right now – but I teach this stuff to police and I have it down pretty well.)

A U.S. Supreme Court case says (in essence) that: Self defense is based upon necessity, and where a lesser degree of force will suffice to solve the problem, then the lesser degree is what is justified.

So, even though your state law may imply that you may use deadly force, the higher Federal standard is that your degree of force must be based upon the necessity of that degree of force.

Quote
To me deadly force is justifiable if there is an intruder in my house. Of course I live in California, anything but a conservative state. Most likely I would be in jail for a long time if shot an intruder and I personally did not feel threatened or could not show evidence of being threatened. None the less I will not take any chances.
(Emphasis added)

As long as you understand that unless your use of force is found to be both justified and necessary, you can be found to be criminally and/or civilly culpable. You would risk financial cost for your criminal defense (plan on $50,000.00 as a base figure), long term incarceration, possible capital punishment (depending on state), loss of income, loss of retirement, loss of insurance coverage, inability to be rehired in some professions, property loss, and (let’s face it) possible disruption of you family unit, etc…

I would rather do it right and substantially reduce my and my family’s risks in the process. It doesn’t do me and my family any good if in the process of trying to defend my family, I end up in jail, my family is without my income, homeless, without the health insurance that my employment brings, without my retirement account, and my family is broken up or tattered because they can’t deal with what has happened, etc…

Just food for thought…

In Pursuit,

Why would someone lie about that?  I'm glad the only Mongrel with less than a full deck is myself.  Well, and Dicho, be he's from Texas and technically Mexican:thumbsup:

<The term Mexican in this post is meant to instill rage in the Texan since they feel that Texas is the center of the universe.  Under no circumstances is it meant to belittle those unlucky enough to border on the Lone Star state.  I personlly love Mexico even though I have never been there.  I also like Taco Bell and Old El Pase Salsa.

I have been on the net for many many yrs Since aol 2.0 and since about 90 91 well been on before the net actually dialing up to many BBS's on my fast 330baud which roughly is .3kbps (this snail mail was still faster). We had our own Chat room for 5 yrs, and what i seen in real life. Nothing That a person can or will do surprises me any more.  I have found that there isnt anything that another humun being won't do to another human being, I just add these up as another thing to read and say well what is next..lol and then go on for the next page..

Yeah, me neither.  I've seen some pretty dumb stuff since 1992, and this one is pretty far up there. Guess it just goes to show that stupid people use computers too.  What a loser.  I'd say I hope he gets some help but actually I really don't care all that much.

the worst one i saw online was when we had a Police,Fire and EMS room on fire talk, this one gilr was suppose to be a emt gal. knew laot of stuff bout it, so thisone guy never pushed it, they kind of did the fall in love over the inter net thing, and talked about marriage and she said she went out and bought her wedding dress and things were all set. about two months went by the guy was going to move to her, so we all watched text chat and heard from both of them together and alone in our voice chat how well things were going, one day he said he had put his house up for sale and had some one put a deposit down about a week later.  So he had buyer real fast. then one day this girls neighbor bought a pc and found her self in our room also on fire talk, then it came out she heard about this marriage thing and told us when they werent on she was married and never had any intentions of going thru with this, With this out things werent good for this guy, Since his house was under contract to sale and a deposit was put on it to lock, he was dooomed, the rrealator took it off market, but by contact with the buyer he could not do anything . So this guy was ready to lose his home on a hoax, Was the last week before he had to leave the buyers credit and income was not enough for it to go thru, so the buyer backed out and by luck he kept his house..

The other one was a guy whou said he was in the acadamy and one day he went to the movies and a robber was in line trying to rob the ticket booth so he shot the robber and killed him. so a few dets in TX that we knew looked it up and found out he was lying alos..lol the fun part know was to catch the ones lying..lol we would question them. like with the fake MP's we have a notto we all know, had to know, caught a few like that. fun fun fun

we had tons of people saying they were cops and ems and fire, but since we had about 50 memebers that wer we investigated many thru connections and found out about 10 were frauds and caught them and snet the info to thier local police for impersonating police on the net..lol and giving legal advice to people .lol well that was the end of that. there was so much stuff that went on i could write a book, But the good news even thogh there are many losers on the net, there still are alot of decent people too. that time will tell how long you know them on the net, the truth allways comes out if you lie, things about lying you lose track of them and it comes out, if your always truthful nothing changes thru out the time knowing them..

so this guy only made a fool on himself and now wont be able to show face, and what ever he says now will be useless cause no one will beleive anything he has to say now..lol

People just dont know what to do with them..lol

Back in the early 90s when the internet started I had a umm an "experience" which taught me what the net is all about early.
I was very green having only used BBS connections. I was trying to figure out IRC channels for the 1st time. I think I was on Undernet and went into the help channel with some questions and how to send .txt files and chat ect.....So

This channel mod starts answering my questions. They are being very helpful and I'm learning all about nagivating channels and how things work online. We then get to how to accept and block sends. I'm then asked to move to another channel so we can work on sending files without all the other text chat. I don't think anything about it and follow.
We get to sending files and this kid I assumed was going to send me a picture. So being naive and no clue what really goes on in the IRC channels I accept this picture.
You can just imagine my shock to open some picture of a nasty old fat and naked man. I'm sitting their with my jaw dropped and appalled. This guy then asks "Do you like?"

I think I pulled the plug right out of the wall at that moment still in shock.... Welcome to the net SunKing.

I learned quick nothing is what it seems online.

If anyone wants some advanced weapons training then I'm quite happy to provide it to those who request it. I also have vast experience in CQB too. I recently put my Father in law through some training down on the range and back at his house.
The single most important thing to remeber about a weapon is that you MUST be prepared to use it, there's other important things but that's number 1. It's one thing to go hunting on a regular basis, but Animals don't shoot back, when you are faced with an incident then training is your saviour, if you stop to think or pause to look into their eyes for a sign of compromise then you will die. You MUST rely on your instincts and that comes from training-properly
